Contract Conditions

You hereby certify that you are at least 18 years of age, and that you are renting the Breast Pump(s) shown on the checkout page from The Feeding Circle LLC. You also certify that you are the account holder of the debit or credit card used for the rental transaction shown on the order or that you are an authorized user who has been given permission by the account holder to use the card. Your completion of the rental transaction constitutes your acceptance of these terms.

Condition of Pumps

Breast Pumps rented from The Feeding Circle LLC are guaranteed to be correct according to your order, and in usable used or new condition. Breast Pumps will be Delivered or available for Pick Up at The Feeding Circle LLC’s discretion and depending upon supplier availability.

Delivery/Pick up

The Feeding Circle LLC relies on the expertise of our staff at The Feeding Circle LLC to deliver your pumps to you on time. Rare problems such as weather delays, rural routes, or system delays could affect the timing of your delivery. The Feeding Circle LLC will work closely with any customer that does not receive their pump within the time frame selected. Orders require a 24 hour notice for pick up or delivery.

Ownership

Breast Pump(s) rented from The Feeding Circle LLC are the property of The Feeding Circle LLC. At no time during the rental period does the renter obtain ownership of the Breast Pump.

Communication

The Feeding Circle LLC will send you notifications and order receipts to the email address(es) you have provided. The Feeding Circle LLC may send you return notifications via email as a courtesy, but The Feeding Circle LLC is not responsible to notify you in any way of the return due date. You are solely responsible for returning the Breast Pump(s) by the due date whether or not you receive a reminder notification from Breast Pump Rentals LLC.

You authorize The Feeding Circle LLC to send you emails and/or SMS text messages that include information about discounts, deals, products and services. You may unsubscribe from these communications at any time. The Feeding Circle LLC may use information about you, including personal information and the information you provide for your rental transaction and/or online account creation to: (1) allow you to participate in features offered or to provide related customer service, such as responding to your questions, complaints or comments; (2) customize content recommendations and offers displayed to you; (3) process a transaction you initiate; (4) provide you with information, products or services; (5) send you special offers from The Feeding Circle LLC, its advertisers, or its third-party business partners; (6) process your registration for rental services, including verifying your e-mail address is active and valid; (7) improve the services and for internal business purposes; (8) contact you with regard to any use of the services and, in its discretion, make changes to policies; (9) for purposes disclosed at the time you provide your information or otherwise give your consent. The Feeding Circle LLC will not ask you for any personal information, account username, and password, or any of your credit or debit card information via email or text message, and you will not provide such information via email or text message. The Feeding Circle LLC will have no responsibility for any misuse of such information if you provide such information via email or text message.

Agreement to Return Breast Pump(s)

You agree to return rented Breast Pump(s) and breast pump parts in the provided pump case to The Feeding Circle LLC, on or before the last day of your rental period. Breast Pump(s) that are not returned to The Feeding Circle LLC will not be cleared from your account and you will continue to be responsible to pay rent until the Breast Pump is returned to our distribution center in Johns Creek GA.

Breast Pump(s) not Returned on Time

We will do our best to make returning your Breast Pump(s) simple and easy. If however, Breast Pump(s) are not returned at the end of the rental period, as specified in the rental agreement, you will be notified via email that your card will be charged for rental extension of the Breast Pump(s). If the Breast Pump(s) is not returned by the end of the extension period and or the debit or credit card charge is declined The Feeding Circle LLC will pursue collections efforts including recovering its Breast Pump or the value of the Breast Pump(s). You hereby authorize The Feeding Circle LLC to charge your debit or credit card in the event of late or unreturned Breast Pump(s) for rent using a 1 month extension rate set forth herein for each month period that you fail to return the Breast Pump and/or for the fair market value of the Breast Pump. We work very hard to resolve every return discrepancy. After all, our wish is to keep you as a happy customer and continue to rent Breast Pump(s) to you throughout your pregnancies. The fair market value of the Breast Pump(s) is determined to be the value of the breast pump at the time it was initially rented; not the value at the time the card is charged.

Maintenance and Care of Breast Pump(s)

You, the renter, agree to keep Breast Pump(s) in good, usable condition. Upon your receipt of the Breast Pump until you return the Breast Pump to The Feeding Circle LLC, you are responsible for keeping the pump in good working condition and to use only as directed by the instructions. In the event that the pump has been damaged by you due to abuse, misuse or alterations, you give authorization for The Feeding Circle LLC to charge you the full fair market value of the pump.

Right to Cancel Orders

The Feeding Circle LLC retains the right to cancel or refuse any order that results from an error in pricing due to typographical errors, miscommunication with our partners, or any other incorrect information.

Refund and Return Policy

Breast Pump Kit

No refund will be issued. Regardless of if it is returned in its original packaging. We strive to provide parents with the highest confidence of quality and safety. Parents can be assured that under no circumstance will they receive a kit that has been delivered to someone else.

Breast Pumps

If a pump is returned within 5 days of original rental date, meaning it must be in The Feeding Circle LLC’s possession; The refund will be the full pump rental amount less a $25 restocking fee. No refunds are issued on the breast pump kit.
If you wish to return your pump and are outside the 5-day window the pump rental refund policy is as follows:

If your original rental was for 2 weeks or 1 month, no refund will be issued.
If you chose a 3 month option:

No partial month refunds will be issued.
Refund will equal monthly fee for any remaining full months.
Example: 3-month rental returned anytime in month 2

Refund will be issued for month 3 at the rate/ per month fees in rental contract

This Refund and Return Policy does not apply if the Breast Pump has been damaged by you due to abuse, misuse or alteration.

Liability

The Feeding Circle LLC shall not be held liable for any damages incurred, physical or emotional, tangible or intangible, for use of this rental.

Rental Periods

We have structured our rental periods to fit the needs of a new parent. Each rental period is detailed below.

2 week Rental (14 days)
1 Month Rental (30 days)
3 Month Rental (90 days)
Extensions (14 days, 30 days)

Extensions

We offer extensions. The cost to extend your rental is a 2 week or 1 month rental rate of the pump you rented. If you find yourself needing to keep your breast pump just a bit longer. Extending your rental period is easy. Simply text or email us and let us know the amount of time to extend.

Collections

You agree that you will not cancel or exceed the purchasing limits of the credit or debit card you provided until the rented Breast Pump(s) is either returned to The Feeding Circle LLC or the non-return fees are paid. If the credit or debit card is declined, your account will be suspended and sent The Feeding Circle LLC for collection purposes. You authorize them to pass your information to any Third Party Collection Agency. You will be responsible for paying all reasonable fees, costs or collection fees assessed by The Feeding Circle LLC or the Third Party Collection Agency.

The Feeding Circle LLC will make reasonable efforts to process transactions in a timely manner. You agree not to hold The Feeding Circle LLC responsible in the event The Feeding Circle LLC does not credit or debit your credit or debit card for a period of time due to circumstances beyond its control. The Feeding Circle LLC makes no guarantees regarding the processing time for charges.

In order for The Feeding Circle LLC to service your account or to collect any amount you may owe, you agree, unless otherwise prohibited by applicable law, that The Feeding Circle LLC or a designated Third Party Collection Agency are authorized to (i) contact you by telephone at the telephone number(s) in the patron contact account information you are providing, including wireless telephone numbers, which could result in charges to you, (ii) contact you by sending text messages (message and data rates may apply) or emails, using any email address you provide and/or (iii) contact you using pre-recorded/artificial voice messages and/or use of an automatic dialing device, as applicable. You acknowledge that you have read this disclosure and agree that the Third Party Collection Agency may contact you as described above.

Except as otherwise provided herein, The Feeding Circle LLC agrees to keep all your personal and payment information confidential in accordance with our privacy policy.

The Feeding Circle LLC, may assign this agreement to a parent or affiliate company at its sole discretion.

The Feeding Circle LLC WARRANTS TO REPAIR OR REPLACE ANY EQUIPMENT WHICH IS OR BECOMES DEFECTIVE UNDER NORMAL USE. The Feeding Circle LLC AND WILL NOT BE LIABLE FOR INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR ANY OTHER DAMAGES RESULTING FROM DEFECTIVE EQUIPMENT; THEIR LIABILITY IS LIMITED TO REPAIR OR REPLACEMENT OF THE EQUIPMENT. THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED.
